Please read these Terms and Conditions carefully before using any services provided by Akshay Tours And Travels. These terms govern all bookings made by phone, WhatsApp, online enquiry form, or any other channel. By booking a trip, you confirm that you have read, understood, and agreed to be bound by these terms.

1. Acceptance of Terms
By booking a cab service with Akshay Tours And Travels, whether by phone, WhatsApp, online enquiry form, or any other means, you agree to be bound by these Terms and Conditions in their entirety. If you do not agree with any part of these terms, you must not use our services.
These Terms and Conditions apply to all passengers, persons making bookings on behalf of passengers, and any third party who uses our services. Use of our services constitutes your acceptance of these terms.
These terms are legally binding. Please read them carefully before making a booking. If you are booking on behalf of another person or a group, it is your responsibility to ensure all passengers are aware of and agree to these terms.
2. Services Provided
Akshay Tours And Travels provides point-to-point cab and taxi services including one-way cab, round-trip cab, outstation taxi, local sightseeing, corporate travel, and tempo traveller hire across Maharashtra, Goa, Karnataka, Telangana, Gujarat, and other covered routes.
2.1 We act as a cab service provider and not as a common carrier. Our services are subject to vehicle and driver availability at the time of booking.
2.2 We reserve the right to substitute a vehicle of equivalent or higher category if the originally booked vehicle is unavailable due to unforeseen circumstances such as breakdown, accident, or operational requirements.
2.3 Service coverage is limited to our operational routes. While we cover routes across India, we do not guarantee availability on all routes at all times. Please confirm route availability when making your booking.
2.4 Akshay Tours And Travels operates exclusively within the legal framework of the Motor Vehicles Act, 1988 and applicable state transport regulations. All trips are conducted within the law.
3. Booking and Confirmation
3.1 A booking is considered confirmed only after our team has verbally or in writing acknowledged acceptance and provided a booking reference, driver name, or trip confirmation via call or WhatsApp.
3.2 Booking requests submitted via enquiry form are not automatically confirmed. They are treated as a request and are subject to availability. We will contact you to confirm within a reasonable time.
3.3 You are responsible for providing accurate trip details including pickup address, destination, date, time, and number of passengers. Akshay Tours And Travels will not be liable for any loss or inconvenience arising from incorrect information provided at the time of booking.
3.4 Advance bookings are strongly recommended, especially for early morning pickups (before 6:00 AM), airport transfers, outstation trips, and group travel with tempo travellers. Last-minute bookings are subject to availability.
3.5 For airport pickup bookings, please provide your flight number and arrival time. We will monitor flight status to adjust pickup time accordingly. We are not liable for delays caused by unannounced flight time changes.
3.6 We reserve the right to decline any booking at our discretion without providing a reason.
3.7 Corporate bookings and bulk bookings by organisations are subject to separate commercial agreements and must be arranged directly with our management.
4. Fares and Payments
4.1 Fares quoted at the time of booking are estimates based on standard route rates. The final fare may vary based on actual kilometres travelled, waiting time, route changes requested by the passenger, and applicable additional charges.
4.2 The following additional charges may apply and will be communicated to the passenger before or during the trip:
— Toll fees and expressway charges (e.g., Mumbai-Pune Expressway, NH toll plazas)
— State border taxes and entry permits for inter-state travel (Karnataka, Goa, Telangana, Gujarat)
— Parking charges at airports, railway stations, hotels, or event venues
— Driver night allowance for trips starting or ending between 11:00 PM and 6:00 AM
— Driver day allowance for multi-day outstation trips (typically ₹300–₹500 per day)
— Hill station access charges applicable at Mahabaleshwar, Lonavala, and other ghat routes
— Waiting charges beyond the free waiting period (see Section 10)
— Return journey empty run charges for one-way trips to certain destinations
4.3 All additional charges are communicated transparently before departure. Passengers are required to pay applicable charges as agreed.
4.4 Akshay Tours And Travels does not currently accept advance online payment. Payment terms (cash, UPI, or other means) will be confirmed at the time of booking.
4.5 Fare disputes must be raised at the time of payment or completion of the trip. Retrospective fare disputes raised after payment has been accepted and the passenger has exited the vehicle will not be entertained.
4.6 Quoted fares do not include GST unless explicitly stated. For corporate clients requiring GST invoices, please inform us at the time of booking.
5. Cancellation and Refund Policy
5.1 Cancellations must be communicated to Akshay Tours And Travels by phone or WhatsApp as early as possible to avoid charges and allow us to reassign the driver.
5.2 Cancellation charges apply as follows:
— Cancellation more than 24 hours before scheduled pickup: No charge.
— Cancellation between 12 and 24 hours before scheduled pickup: Up to 25% of the agreed fare may be charged.
— Cancellation less than 12 hours before scheduled pickup: Up to 50% of the agreed fare may be charged.
— Cancellation less than 2 hours before scheduled pickup: Up to 75% of the agreed fare may be charged.
— No-show (passenger not present at pickup location within 30 minutes of scheduled time without prior notice): Full fare may be charged.
5.3 For multi-day and outstation round-trip bookings, cancellation of the return leg after the outward journey has commenced will attract a charge of up to 50% of the return leg fare.
5.4 In the event of cancellation by Akshay Tours And Travels due to vehicle breakdown, driver unavailability, or other operational reasons beyond our control, no cancellation fee will be charged to the passenger. We will make reasonable efforts to arrange an alternative vehicle at the earliest.
5.5 Refunds, where applicable, will be processed within 7 working days of cancellation confirmation through the same payment method used.
5.6 Force majeure cancellations (floods, road blockades, bandh, curfew, natural disasters) will be handled on a case-by-case basis with no penalty to either party.
6. Waiting Time Policy
6.1 A free waiting period of 15 minutes is provided for local pickups from residential or commercial addresses.
6.2 For airport and railway station pickups, a free waiting period of 30 minutes from the scheduled pickup time (or actual arrival time for tracked flights/trains) is provided.
6.3 After the free waiting period has elapsed, waiting charges will apply at the rate confirmed at the time of booking. Standard rates are approximately ₹100–₹150 per hour, subject to vehicle type.
6.4 If the driver is asked to wait at an intermediate stop (e.g., while a passenger visits a temple, office, or hospital), waiting charges will apply from the moment the vehicle stops and the driver is not in active transit.
6.5 For local sightseeing and day rental bookings, the agreed package hours begin from the time the vehicle departs from the pickup location, not from the time the passenger boards. Overtime charges apply for hours beyond the agreed package.
6.6 Akshay Tours And Travels is not responsible for any loss incurred by the passenger due to traffic delays causing the driver to arrive late. We will communicate any expected delays promptly.
7. Passenger Conduct
7.1 Passengers must behave in a lawful, courteous, and respectful manner towards the driver and other passengers at all times throughout the journey.
7.2 Smoking of any kind (cigarettes, bidis, e-cigarettes, hookahs) is strictly prohibited inside all vehicles.
7.3 Consumption of alcohol or illegal substances inside the vehicle is strictly prohibited. Passengers who appear to be intoxicated may be denied boarding at the driver's discretion.
7.4 Passengers are responsible for any damage caused to the vehicle due to their negligence or misconduct, including but not limited to spilling food or drinks, physical damage to seats or fittings, and soiling. The cost of professional cleaning or repairs will be charged to the responsible passenger.
7.5 The driver has the right to refuse to carry any passenger who is behaving in an abusive, threatening, violent, or sexually inappropriate manner, or whose physical condition may pose a health or safety risk. In such cases, no refund will be provided and the matter may be reported to authorities.
7.6 Passengers must not distract the driver while the vehicle is in motion, including by making requests that require the driver to take their eyes off the road or operate devices.
7.7 Passengers are responsible for ensuring they have all necessary travel documents, government-issued identification (Aadhaar, PAN, Driving Licence, Passport), and any state-specific permits required for cross-border travel.
7.8 Passengers with medical conditions that may require emergency assistance are advised to inform the driver before departure. We recommend carrying any prescribed medication and emergency contact information.
8. Luggage and Belongings
8.1 Passengers are permitted to carry reasonable personal luggage within the vehicle's luggage capacity. The following are indicative limits:
— Sedan (Swift Dzire): 2 large bags or equivalent
— MUV (Ertiga / Innova): 3–4 large bags or equivalent
— Tempo Traveller: luggage as per group size, stowed under seats
8.2 Excessive luggage that does not fit within the vehicle and affects passenger safety or comfort may not be accommodated. It is the passenger's responsibility to inform us of excess luggage at the time of booking.
8.3 Carriage of the following items is strictly prohibited:
— Weapons, firearms, and ammunition
— Flammable or explosive materials
— Controlled substances and illegal drugs
— Wildlife products and contraband
— Any item that is illegal under Indian law
— Any item that could damage the vehicle or endanger its occupants
8.4 Akshay Tours And Travels and its drivers are not liable for any loss, theft, or damage to passenger belongings left in the vehicle. Passengers are advised to check the vehicle upon exiting and retrieve all personal belongings.
8.5 If any item is found in a vehicle after the passenger has departed, Akshay Tours And Travels will make reasonable efforts to contact the passenger using the booking contact details. A retrieval fee covering the driver's transportation cost may apply. Unclaimed items will be held for 30 days and then disposed of.
9. Outstation and Multi-Day Trip Rules
9.1 Outstation trips are defined as trips with a one-way distance of 100 km or more, or trips requiring an overnight stay by the driver.
9.2 For outstation trips, a driver allowance (batta) is charged per day in addition to the kilometre-based fare. This covers the driver's accommodation, meals, and personal expenses. The applicable allowance will be confirmed at the time of booking.
9.3 Round-trip outstation bookings are calculated on total kilometres from pickup to drop and back to the pickup city, regardless of the actual return route taken.
9.4 One-way outstation bookings may attract a higher per-kilometre rate to account for the return empty run of the vehicle. This will be communicated at the time of quoting.
9.5 For multi-day bookings, the package fare covers a defined daily kilometre allowance and time limit. Kilometres or hours exceeding the agreed daily limit will be charged at an overtime rate as communicated at the time of booking.
9.6 The driver's rest period must be respected on multi-day trips. Drivers should not be made to drive continuously for more than 8 hours without at least a 30-minute rest break. Passengers should factor this into their travel plans.
9.7 For overnight trips, the passenger is not responsible for the driver's accommodation unless specifically agreed to in advance. The driver allowance already accounts for accommodation.
9.8 Route changes during an outstation trip that significantly increase the total distance will result in a revised fare. Any additional charges will be communicated to and agreed by the passenger before the route change is made.
10. Tempo Traveller Specific Terms
10.1 Tempo Traveller bookings are available for groups of 9 to 17 passengers. Maximum passenger capacity must not be exceeded under any circumstances, as this is both illegal under the Motor Vehicles Act and a safety hazard.
10.2 Passengers travelling in a Tempo Traveller agree to behave in a manner that does not disturb or endanger other passengers in the vehicle. Any misconduct by one passenger that leads to termination of the trip will not result in a refund for any member of the group.
10.3 Luggage for Tempo Traveller bookings should be compactly packed and stored in designated areas. Passengers are responsible for loading and unloading their own luggage.
10.4 For pilgrimage-specific Tempo Traveller bookings (e.g., Shirdi, Pandharpur, Ashtavinayak circuit), religious items such as flowers, coconuts, and prasad are permitted. However, items that produce strong odours, smoke, or fire (agarbatti, dhoop, etc.) must not be used inside the moving vehicle.
10.5 Music, video, or audio entertainment may be played through the in-vehicle system at a reasonable volume that does not distract the driver. Final discretion on audio levels rests with the driver.
10.6 Children occupying seats are counted as full passengers. Infants and toddlers on laps do not count towards the passenger limit but must be secured safely and are the full responsibility of the accompanying adult.
11. Vehicle Standards and Driver Obligations
11.1 Akshay Tours And Travels is committed to maintaining a fleet of clean, road-worthy, and air-conditioned vehicles. All vehicles undergo regular maintenance and safety checks.
11.2 All vehicles operated by Akshay Tours And Travels hold valid:
— Commercial vehicle registration under the Motor Vehicles Act, 1988
— Valid commercial vehicle insurance (comprehensive)
— Valid pollution under control (PUC) certificate
— Required state and interstate permits
11.3 All drivers engaged by Akshay Tours And Travels are required to hold:
— A valid commercial driving licence (Transport category)
— Valid personal identification documents
— Familiarity with the assigned routes
11.4 Drivers are instructed to follow all traffic laws, maintain safe speeds, avoid mobile phone use while driving, and not consume alcohol or substances before or during a trip.
11.5 If a passenger has concerns about the driver's behaviour, driving manner, or condition during a trip, they should contact Akshay Tours And Travels immediately at +91 97674 77009. We take all such reports seriously and act promptly.
11.6 In the event of a vehicle breakdown during a trip, Akshay Tours And Travels will make best efforts to arrange an alternative vehicle at the earliest. If a replacement cannot be arranged within a reasonable time, a proportionate refund for the uncompleted portion of the journey will be provided.
12. Route Changes and Diversions
12.1 The driver may take a route different from the passenger's preferred route if road conditions, traffic, police orders, or safety considerations require it. The driver's decision on the route to be taken is final in the interest of safety and efficiency.
12.2 Passengers may request a specific route at the time of booking or at the start of the trip. Such requests will be honoured if they do not significantly increase the journey time or distance. If a requested route results in additional distance or toll charges, these will be borne by the passenger.
12.3 Akshay Tours And Travels is not liable for delays caused by road construction, traffic congestion, road accidents not involving our vehicle, or diversions ordered by government authorities.
12.4 For ghat routes (Mahabaleshwar, Matheran, Panchgani, Amboli, etc.), the driver may refuse to proceed during adverse weather conditions, including heavy rain, fog, or landslide risk, in the interest of passenger safety. No cancellation charges will apply in such cases.
13. Special Travel Categories
13.1 Pilgrimages and Religious Travel
For trips to religious destinations (Shirdi, Pandharpur, Ashtavinayak, Kolhapur, Jejuri, Trimbakeshwar, etc.), passengers are reminded that during peak religious festival periods (Wari, Navratri, Eid, Christmas, etc.), traffic and crowd conditions may significantly affect journey times. Akshay Tours And Travels is not responsible for delays during peak festival periods.
13.2 Medical Travel
Passengers travelling for medical treatment or emergencies are advised to inform us at the time of booking so the driver can be appropriately briefed. For medical emergencies during transit, the driver will provide reasonable assistance and divert to the nearest medical facility if required. Akshay Tours And Travels maintains no liability for health outcomes.
13.3 Airport and Railway Transfers
For airport and railway station drops, the driver will reach the terminal/entrance gate. Entry into departure areas, parking bays, or restricted zones beyond the public drop zone is subject to applicable parking fees that will be borne by the passenger. For pickups, passengers are responsible for informing us of terminal/platform changes.
13.4 Weddings, Events, and Celebrations
Vehicles booked for weddings or events must be used strictly for transportation. Decorating vehicles requires prior written approval. Any damage to the vehicle from decoration materials will be charged to the booking party.
13.5 Children and Minors
Children below the age of 12 must be accompanied by a responsible adult at all times. Akshay Tours And Travels does not provide child safety seats unless specifically requested and confirmed in advance. Parents or guardians are solely responsible for the safety of minor passengers in their care.
14. Pets and Animals
14.1 Pets and animals are not permitted in our vehicles without prior written approval from Akshay Tours And Travels.
14.2 If pet travel is approved on a case-by-case basis, the following conditions apply:
— The pet must be kept in a proper carrier or cage at all times during the journey.
— Any soiling or damage to the vehicle caused by the pet will be charged to the passenger.
— The passenger assumes full liability for any injury to the driver or other passengers caused by the pet.
14.3 Guide dogs and certified assistance animals accompanying passengers with disabilities are always permitted, provided advance notice is given.
15. Limitation of Liability
15.1 Akshay Tours And Travels shall not be liable for any delay, failure to provide service, or loss arising from circumstances beyond our reasonable control, including but not limited to traffic conditions, road closures, floods, natural disasters, police action, bandhs, strikes, riots, or vehicle breakdown.
15.2 Our maximum liability to any passenger in connection with any single trip shall not exceed the total fare paid for that trip.
15.3 We are not liable for any indirect, consequential, or special damages including but not limited to missed flights, missed train connections, missed events, loss of business opportunity, loss of income, or other incidental losses arising from delays or failure of service.
15.4 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be lawfully excluded under applicable Indian law.
15.5 Drivers employed or engaged by Akshay Tours And Travels are required to carry valid driving licences and ensure vehicles are road-worthy before each trip. However, Akshay Tours And Travels cannot guarantee complete freedom from road accidents or mechanical failures, which are inherent risks of road travel.
15.6 Passengers are advised to purchase their own travel and personal accident insurance for comprehensive coverage. Akshay Tours And Travels's commercial vehicle insurance covers third-party and vehicle-level liability as required by law.
16. Insurance
16.1 All vehicles used by Akshay Tours And Travels carry valid comprehensive commercial vehicle insurance as required under the Motor Vehicles Act, 1988 and applicable state regulations.
16.2 The commercial vehicle insurance covers accidental damage to the vehicle and third-party liability as mandated by law.
16.3 Passengers are strongly advised to obtain personal travel insurance for additional protection covering personal accident, baggage loss, trip cancellation, and medical emergencies.
16.4 Akshay Tours And Travels does not provide personal accident insurance for passengers as part of the cab fare. Any injury-related claims must be directed to the vehicle's insurer. We will cooperate fully with all lawful insurance investigations, including providing trip records and driver details.
17. Complaints and Grievance Redressal
17.1 Akshay Tours And Travels is committed to resolving passenger complaints promptly and fairly. If you have a complaint about our service, driver conduct, fare, or any other matter, please contact us as soon as possible.
17.2 Complaints may be submitted by:

17.3 We acknowledge all complaints within 24 hours and aim to resolve them within 5 working days. Complex complaints may take longer, and we will keep you informed of the progress.
17.4 If you are dissatisfied with our response to a complaint, you may escalate the matter to:
— The State Consumer Disputes Redressal Commission (SCDRC) of Maharashtra
— The Regional Transport Office (RTO) in case of driver or vehicle regulatory concerns
— The National Consumer Helpline (NCH) at 1915
17.5 We genuinely value feedback — positive or negative — as it helps us improve our service. Even if you don't have a formal complaint, you are welcome to share your experience with us.
18. Privacy and Data Protection
18.1 When you make a booking, you provide personal information such as your name, phone number, and travel details. This information is used solely to confirm and manage your booking and to communicate with you about your trip.
18.2 We do not sell, trade, or share your personal information with third parties except where necessary to fulfil your booking (e.g., sharing your name and contact number with the assigned driver).
18.3 By providing your contact details, you consent to receiving booking confirmations, trip updates, driver details, and service-related communications from Akshay Tours And Travels via phone, WhatsApp, or SMS.
18.4 For full details of how we collect, use, and protect your personal information, please read our Privacy Policy at akshaytoursandtravels.com/privacy.
18.5 You may request access to or deletion of your personal data by contacting us at info@akshaytoursandtravels.com. We will comply with all applicable provisions of Indian data protection laws.
19. Website and Intellectual Property
19.1 All content on this website — including text, images, design, graphics, logos, and data — is the property of Akshay Tours And Travels and is protected under applicable Indian intellectual property laws including the Copyright Act, 1957 and the Trade Marks Act, 1999.

20. Force Majeure
Akshay Tours And Travels shall not be in breach of these Terms and Conditions and shall not be liable for any delay or failure to perform our obligations where such delay or failure results from events, circumstances, or causes beyond our reasonable control.
Such events include but are not limited to: natural disasters (floods, earthquakes, cyclones), acts of God, acts of government or public authority, civil unrest, riots, war, terrorism, epidemics, pandemics, curfews, bandhs, road closures ordered by authorities, and extreme weather conditions that make travel unsafe.
In force majeure situations, both parties will be excused from their obligations for the duration of the event. We will communicate with you as early as possible and work to reschedule or refund as appropriate.
21. Governing Law and Dispute Resolution
21.1 These Terms and Conditions are governed by and construed in accordance with the laws of India, including the Motor Vehicles Act 1988, the Consumer Protection Act 2019, the Indian Contract Act 1872, and other applicable legislation.
21.2 The Courts of Maharashtra shall have exclusive jurisdiction over any dispute arising from or connected to these terms and conditions or the services provided by Akshay Tours And Travels.
21.3 In the event of a dispute between a passenger and Akshay Tours And Travels, both parties agree to first attempt to resolve the matter amicably. Please contact us at info@akshaytoursandtravels.com or +91 97674 77009 with a written description of the dispute.
21.4 If a dispute cannot be resolved amicably within 30 days of written notice, either party may seek resolution through the Consumer Disputes Redressal Forum or the appropriate courts in Maharashtra, India.
21.5 Nothing in this clause prevents either party from seeking urgent injunctive or interim relief from a court of competent jurisdiction.
22. Amendments to Terms
Akshay Tours And Travels reserves the right to modify these Terms and Conditions at any time. Updated terms will be published on this page with a revised effective date. Changes take effect from the date of publication.
Your continued use of our services after any changes to these terms constitutes your acceptance of the updated terms. We encourage you to review this page periodically, especially before making a booking.
For significant changes, we will make reasonable efforts to notify regular customers via WhatsApp or phone.
24. Severability
If any provision of these Terms and Conditions is found by a court of competent jurisdiction to be unlawful, void, or unenforceable, that provision shall be deemed severable from the remaining provisions and shall not affect the validity and enforceability of the remaining provisions, which shall continue in full force and effect.

23.4 Third-Party Information
Any third-party information referenced on this website, including route distances, travel durations, and toll information, is provided for general guidance only. Akshay Tours And Travels does not warrant the accuracy or completeness of such information.
